Welcome to Thistle Type. These Terms of Use (“Terms”) govern your access to and use of the Thistle Type website and the purchase and use of our digital font products. By using this website or purchasing our products, you agree to be bound by these Terms. If you do not agree, please do not use this website.

1. About Us

Thistle Type is a digital type foundry based in Scotland, operated by Rachael Arnott as a sole trader. We design and distribute original typefaces through our online store powered by WooCommerce.

2. Font Licences

When you purchase a font from Thistle Type, you are granted a limited, non-exclusive, non-transferable, perpetual licence to use the font in accordance with the applicable End User Licence Agreement (“EULA”).

No ownership rights are transferred. All intellectual property rights in the fonts remain with Rachael Arnott trading as Thistle Type.

Each licence type (Desktop, Web, App, E-Publication, Editable Template, or other agreed licence) has specific usage rights and restrictions. You are responsible for ensuring your use complies with the licence purchased.

If your intended use falls outside the scope of the standard licences, you must obtain written permission before proceeding.

In the event of any conflict between these Terms and a specific Font Licence Agreement (EULA), the EULA shall prevail in relation to font usage rights.

3. Licence Restrictions

Unless expressly permitted by your licence, you may not:

• Resell, sublicense, share, or redistribute the font files
• Upload the fonts to font-serving, conversion, recognition, or archive platforms
• Use the fonts in machine learning systems, AI training, generative design systems, or automated content generation without prior written consent
• Modify the fonts to create a new font for redistribution
• Allow the fonts to be extracted from any product or platform
• Use the fonts in unlawful, infringing, deceptive, hateful, or discriminatory content
• Violate any applicable copyright, trademark, or intellectual property laws

Unauthorised use may result in immediate termination of your licence and legal action where appropriate.

4. Client Work

If you are a designer, agency, or consultant, you may use the fonts to create work for clients under your licence.

However, the licence remains with you. If your client requires the font files for their own internal use, editing, website hosting, app embedding, or other ongoing use, they must purchase the appropriate licence directly from Thistle Type.

5. Digital Products & Delivery

All products sold by Thistle Type are digital downloads only. No physical goods are supplied.

After successful payment:

• A download link will be provided on the order confirmation page
• A copy will be sent to your email address
• Downloads may also be accessed through your account dashboard (if an account is created)
• You are responsible for backing up your files after download. If you lose access, contact hello@thistletype.com with your order details and we will assist where possible

6. Pricing, VAT & Payments

Prices are displayed in GBP by default. Where available, prices may be shown in your local currency. The final amount charged is the currency displayed at checkout.

Thistle Type is VAT-registered in the United Kingdom and registered under the EU One-Stop Shop (OSS) scheme for digital goods.

• UK customers are charged UK VAT
• EU customers are charged VAT based on their country of residence
• VAT is calculated automatically at checkout
• Customers outside the UK and EU may be responsible for local taxes or import duties where applicable

A VAT invoice is issued automatically upon purchase.

Prices and accepted payment methods may change at any time.

7. Refunds & Consumer Rights

Due to the nature of digital goods, we do not offer refunds for change-of-mind purchases once you have downloaded the fonts and consented to immediate access.

If the fonts are defective, misdescribed, or you experience a technical issue, please contact hello@thistletype.com within 14 days of purchase. Replacement files will be provided where possible.

Refunds may be issued where appropriate, including where required under UK or EU consumer protection law.

Nothing in these Terms limits your statutory rights as a consumer.

8. Promotions & Discounts

Promotional discounts may be offered from time to time. Promotions:

• Apply only during the stated period
• Cannot be combined unless explicitly stated
• May be withdrawn or modified at any time

9. Website Use

You agree not to:

• Interfere with or disrupt the website’s functionality
• Attempt to gain unauthorised access to any part of the website
• Use the website in any way that may damage, disable, or impair our services

We reserve the right to suspend or restrict access where misuse is suspected.

10. Third-Party Services

Our website operates using third-party platforms and service providers, including WordPress and WooCommerce.

While we select providers carefully, we are not responsible for their availability, security, or performance. Your use of third-party services is governed by their own terms and privacy policies.

11. Modifications to Products or Services

We may modify, update, or discontinue fonts, services, pricing, or licence terms at any time.

Updates to licence terms apply prospectively and do not retroactively alter licences already granted, unless required by law.

12. Termination

We may suspend or terminate your access to the website or revoke a licence if you breach these Terms or the applicable EULA.

If your licence is terminated, you must immediately cease use of the fonts and delete all copies in your possession or control.

13. Force Majeure

We are not liable for delays or failure to perform obligations due to events beyond our reasonable control, including but not limited to natural disasters, internet outages, war, regulatory changes, or supplier failures.

14. Minimum Age

You must be at least 16 years old to purchase from this website, or have the consent of a parent or legal guardian where required by law.

15. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and any applicable Font Licence Agreement (EULA), form the entire agreement between you and Thistle Type and supersede any prior communications.

16. Governing Law

These Terms are governed by the laws of Scotland.

If you are a consumer resident in the UK or EU, you may also rely on mandatory consumer protection laws in your country of residence, and disputes may be brought in the courts available to you under those laws.
